Introductory provisions

The internet shop https://www.onceathome.com (hereinafter referred to as the "internet shop") is operated by Once@Home, Ltd, with its registered office at Londýnská 254/7, Vinohrady, 120 00 Prague, ID: 09422595, registered in the Commercial Register kept by the Municipal court in Prague under file No. C 335429 / MSPH (hereinafter referred to as the “Seller”), with a bank account at Česká spořitelna and Account No.: 5844434389/0800.

A consumer is a natural person who does not act within the scope of his business or other entrepreneurial activity when concluding and fulfilling the contract.

An entrepreneur is a buyer who is not a consumer. An entrepreneur is also considered to be any person who concludes contracts related to his own business, production or similar activities or in the independent performance of his profession, or a person who acts in the name or on behalf of the entrepreneur.

A buyer is any visitor to an online store, regardless of whether he is acting as a consumer or as an entrepreneur.

These general terms and conditions govern the mutual rights and obligations of the parties arising from the purchase agreement concluded between the seller and the buyer through an online store (hereinafter referred to as the "purchase agreement").

Business conditions are an integral part of the purchase contract. Legal relations of the participants not regulated by these business conditions are governed by the relevant provisions of Act No. 89/2012 Coll. of  the Civil Code of Czech Republic. Legal relations between the seller and the consumer are also governed by Act No. 634/1992 Coll., On consumer protection, as amended. The wording of the terms and conditions may be changed or supplemented by the seller. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the terms and conditions.


Conclusion of the purchase contract

Prices in the online store may change continuously. The stated price of the goods is valid at the time of submitting the order.

The offer of goods within the online store is a presentation of the offered goods and is not in itself a proposal to conclude a purchase contract.

The proposal for concluding a purchase contract between the buyer and the seller is a duly completed order of the buyer. By sending the order, the buyer confirms that he has read the terms and conditions and agrees with them in full.

The moment of concluding the purchase contract is a confirmation email, which the seller sends to the buyer to the electronic address specified in the order.

The seller is always entitled, depending on the nature of the order (quantity of goods, purchase price, estimated shipping costs) to ask the buyer for additional confirmation of the order.

The method of delivery of goods is determined by the seller. In the event that the mode of transport is contracted on the basis of the buyer's request, the buyer bears the risk associated with such mode of transport, including any additional costs for the selected mode of transport.

Method of payment: payment card via payment gateway, bank transfer after completing the order, via PayPal and Apple Pay. The seller is entitled to demand payment in advance.

When choosing to pay by credit card over the Internet, the buyer will be redirected to a third-party payment server after completing the order, where he will fill in the necessary payment details. After verifying their validity, the order will be confirmed and the purchase price will be deducted from the buyer's account.

When choosing payment by bank transfer, the buyer will pay the price of the order before its settlement to the seller's bank account, i.e. the goods will be sent to the buyer only after the purchase price has been credited to the seller's account. To process the order, it is necessary to pay the payment under the variable symbol, which is the order number and which the buyer will receive when completing the order. In the case of payment for goods by bank transfer, the purchase price is considered paid on the day when the relevant amount was credited to the seller's account.

When choosing to pay via PayPal or Apple Pay, the buyer will be redirected to a third-party server after completing the order, where he will be asked to log into his account. After verifying the validity and sufficient balance on the account, the order will be confirmed and the purchase price will be deducted from the buyer's account.

According to the Act on the Registration of Sales, the seller is obliged to issue a receipt to the buyer. At the same time, he is obliged to register the received revenue with the online tax administrator; in the event of a technical failure, within 48 hours at the latest.



Rights and obligations arising from the conclusion of the purchase contract

The seller is obliged to deliver the ordered goods to the buyer at the agreed price and the buyer is obliged to take over the goods and pay the purchase price.

In the event of a breach of the terms of the purchase contract or business conditions by the buyer, the seller has the right to withdraw from the purchase contract. Unless otherwise provided by law, in such a case the buyer is obliged to reimburse the seller for all costs associated with his order, especially the cost of sending the goods, if the buyer does not take it over.

The data necessary for the conclusion of the purchase contract provided by the buyer are considered correct by the seller.

All messages of the seller can be delivered to the buyer to the electronic address specified in his user account or specified by the buyer in the order.
